The Federal Motor Carrier Safety Administration (FMCSA), which is part of the U.S. Department of Transportation, has established regulations governing the content and maintenance of driver qualification files. These regulations apply to both interstate and intrastate carriers.

 

The driver qualification file typically includes the following documents and information:

  1. Driver's Application for Employment: This includes the driver's personal information, employment history, and previous driving experience.
  1. Motor Vehicle Record (MVR): A copy of the driver's motor vehicle record, which provides details about the driver's driving history, violations, and accidents.
  1. Commercial Driver's License (CDL): A copy of the driver's commercial driver's license or the equivalent state-issued license.
  1. Medical Examiner's Certificate: A copy of the driver's valid medical certificate, indicating that they meet the physical qualifications required for operating a CMV.
  1. Pre-employment Screening Program (PSP) Records: Records obtained from the FMCSA's PSP, which provides information about the driver's crash and inspection history.
  1. Safety Performance History: Information obtained from previous employers regarding the driver's safety performance and any drug and alcohol testing records.
  1. Road Test Certification: Documentation confirming that the driver has successfully completed a road test demonstrating their ability to operate the specific type of CMV they will be driving.
  1. Annual Review of Driving Record: A yearly review of the driver's motor vehicle record to ensure that they continue to meet the carrier's standards for safe driving.
  1. Driver's Certification of Violations: A signed statement from the driver disclosing any motor vehicle violations or license suspensions during the previous 12 months.
  1. Drug and Alcohol Testing Records: Documentation of the driver's drug and alcohol testing, including pre-employment tests, random tests, and post-accident tests.

Driver qualification files must be maintained for each driver throughout their employment with the carrier and for an additional three years after the driver's employment is terminated. These files help ensure that carriers only employ qualified and safe drivers and demonstrate compliance with FMCSA regulations during safety audits and inspections.
